A ROUGH sleeper raped a victim with learning disabilities after forcing his way into his room, a court heard.

Lliue Ciubotaru, 30, and from Romania, denies entering a supported living facility in the borough of Southend and forcing his way into the victim’s bedroom before sexually assaulting him.

A statement from the sister of the alleged victim, who cannot be named for legal reasons, was read to the jury by prosecutor David Wilson at Basildon Crown Court yesterday.

It stated: “I received a phone call from the home. They told me my brother had been sexually assaulted that night.

“I made my way to the house and later took my brother back to my home in Southend.

“Throughout the afternoon and the evening, he told me bits and pieces of what had happened.

“What he did tell us was that on Sunday, in the early hours, he was in his friend’s flat because he had Sky television.

“He said the doorbell rang so they both went to the front of the building.

“They opened the door to the attacker who asked for flat two.

“My brother didn’t say whether he knew him or not.

“His friend let the attacker in and he followed my brother down the corridor to his flat. “My brother went in and was then pushed from behind by the attacker who then entered and locked the door behind him.

“My brother said the attacker had a drink with him but not what drink it was. The attacker has then pushed my brother onto the bed and taken one of his cigarettes while my brother was struggling.

“He did not tell us anymore and I did not ask as I did not want to upset him.”

The court had previously heard it was at this point the alleged victim says he was raped. His friend called the police who arrived within 20 minutes and arrested the defendant while he was still in the flat.

In a separate statement, from the victim’s key worker responsible for his welfare at the home, the court heard he had made comments relating to the alleged assault.

The key worker said in her statement: “At one point, I went into his room to support him.

“He said ‘he pushed me down on the bed. He really hurt me’.

“He acted out laying face-down on the bed at the same time.”

The prosecution say he had injuries consistent with anal sex as well as bruising to his shoulder and abrasions on his right hip and the right side of his neck following the alleged incident on December 11, 2016.

Mr Wilson then read agreed facts to the jury which included a report from a forensic psychologist who had examined the complainant which stated he did not have the capacity to consent.

The defendant, supported by an interpreter, denies rape and theft at Basildon Crown Court.
